摘要：新闻自由承载和体现了表达自由并且是民主法治社会的重要机制之一; 同时隐私权作为一种基本权利已获得普遍的认同并且在国际社会已经或正在成为民事权利。但是, 二者作为现代社会的基本权利却本质地存在冲突，并且随着社会的快速发展这种冲突日渐突现。本文从二者的概念入手分析了两者冲突的原因及表现,进而提出了应从理论、法律和文化三个层面来协调规制二者之间的冲突的措施。

Abstract: Freedom of the press carrying and reflects the freedom of expression and is one of the important mechanisms of democracy and the rule of law society; privacy as a fundamental right has gained general acceptance and civil rights in the international community have been or are becoming. However, both the fundamental rights of the modern society but essentially there is a conflict, the growing emergence of this conflict and with the rapid development of society. Start from the concept of the two analyzed both the causes of conflict and performance, and thus should theory, law and culture at three levels to coordinate regulation between the two conflicting measures.

新闻自由与隐私权都是宪法所保护的基本权利。对于一个民主法治的现代文明社会来说,二者都是非常必要的并且缺一不可。但它们之间的冲突却从来没有停息过。尤其是在现代信息技术飞速发展、人际交往日趋复杂和密切的今天, 新闻自由和隐私权之间的矛盾日益凸显。任何权利都是有界限的。一种权利的界限是通过其他的一种或者几种权利的规制来限定的。当这两者发生冲突时，如果偏倚一方，势必会给另一方带来损害，相反，如果平衡好二者，就会体现权利的关联性。因此，本文围绕新闻自由与隐私权这对权利之间的冲突而展开进而探讨如何协调两者之间的冲突。
