【摘要】近些年来，随着未成年学生伤害事故的急剧增多，学生和学校对簿公堂的现象屡见不鲜，成为全社会普遍关注的热点问题之一。未成年学生伤害事故中学校侵权责任的认定成为法学界讨论的热点之一。故本文从法律视角探析未成年学生伤害事故中学校承担侵权责任的认定问题。本文认为，无过错责任原则应当适用于未成年学生伤害事故，公平责任原则仍有适用空间，对过错的认定应当采用客观标准说，对因果关系的认定应采相当因果关系说。

【Abstract】In recent years, with the sharp increase of minor student hurts accident, phenomenon that students and schools confront at Court is not uncommon and becoming one of the hottest issues of the society. Tort liability of minor students’ injury in schools becomes the focus of the legal community. So this is an article on underage students' injury accident in school with bearing the identification of tort liability from a legal perspective. This paper take for adopting principle of liability without fault should apply to minor injuries, yet impartial responsibility principle can still play a roll, we should adopt the theory of objective standard in fault identification，and relative theory of relative causation of objectivity in causation identification.
