摘要：随着人们法制观念的增强，行政纠纷的增多，行政主体在各项行政活动中应重视比例原则这一行政法的基本原则，以促进行政行为不仅合法而且合理，这也是我国向法治社会迈进的重要一步。但在我们生活和社会实践中，政府行政权的行使导致公共利益和公民个人权利产生摩擦从而引发矛盾的事件屡见不鲜，并且这一矛盾难以从根本上消除。我国行政法上至今还没有关于比例原则的明确概念,在行政立法、行政执法及行政诉讼实践中也没有引起足够的重视。本文从我国行政执法中比例原则确立及适用存在的问题出发，并以国外的比例原则作为借鉴，对我国行政执法中的比例原则进行研究。
