摘要：传销活动屡禁不止，不仅严重影响了市场经济秩序，而且严重危害了社会和谐稳定，对商业诚信体系和社会伦理道德体系也造成了巨大破坏。本文以对传销进行法律规制作为出发点，通过对我国在打击传销的刑事立法和行政立法以及市场监管等方面的基本问题进行分析，深刻认识当前我国打击传销的立法现状和存在的缺陷，并通过借鉴国外的立法状况和实践成果，提出法律建议和治理对策。

我国对传销进行法律规制，建立打击传销的部门协作机制和处罚机制，扩大打击传销的适用对象，完善市场监管及个人信用的长效机制。有利于扩大传销行为的打击范围，构建良好的法律机制，有利于维护人民群众的合法权益和维护正常的社会经济秩序。笔者水平和学问非常有限，只能提出相当浅薄的建议，希望能为进一步打击传销犯罪活动提供一些思考。打击传销是一项长期、艰巨的工作，将不断面临新问题、新挑战。我相信，随着法律制度的不断健全，市场环境的日益成熟，我国在打击传销犯罪方面必能探索出更为有效的途径和方法。
