摘要:随着我国社会主义市场经济体制的建立和发展，劳动用工的形式也多种多样，现代化生产各种机械化程度的提高，我国的工伤保险制度滞后于社会经济发展。本文首先提出完善工伤认定及待遇制度的重要性，通过对我国工伤保险制度在工伤认定的标准、主体的决定权归属、处理工伤待遇程序性问题和工伤保险意识薄弱等方面存在的诸多问题进行了探究和分析。针对这些问题，提出了在法律制度上完善认定标准，明确工伤认定主体的决定权，提高及强制执行工伤待遇制度，加强用人单位和劳动者参保意识的宣传教育的具体措施，以期更加有效地解决工伤认定及待遇的纠纷和矛盾，并促使我国社会和谐、健康发展。

Abstract:With our country socialist market economy system establishing and developing, labor and employment form varied and modern production all sorts of mechanization degree raised also. Industrial injury insurance system of our country lags behind the social economy development. This paper firstly puts forward industrial injury to maintain and perfect the importance of treatment system, by industrial injury insurance system of our country in the treatment of industrial injury determination and standard. The main body of the decision attribution, entity processing industrial injury treatment of industrial injury insurance and weak consciousness, etc. There is so much problem to carry out the research and analysis. Aiming at these problem, puts forward the legal system in the perfect determination standards, clear industrial injury of the main body of the decision, improve and enforce industrial injury treatment system, strengthen the employing unit ginseng protect consciousness in the promotion of the education of the specific measures. Author hopes that the more effective to solve industrial injury and treatment of the disputes and the more promote social harmony in our country and development.

工伤保险是指劳动者在生产劳动和工作中遭受意外伤害或因长期接触职业性有毒因素引起的职业病好伤害后，暂时、部分、或永久失去劳动能力，由国家或社会给予负伤、致残者、死亡者本人及其家属物质帮助的一种社会保障制度。工伤保险的主要内容有医疗救治、收入补偿、遗属抚恤和职业康复。工伤保险是社会保险的一个重要分支，是社会化大生产的产物。它关系到维护千百万劳动者的基本权利和切身利益，关系到人民生活、经济发展和社会稳定。随着社会主义市场经济体制的建立，我国目前的工伤保险制度难以适应社会主义市场经济发展的需要。改革现行工伤认定及工伤待遇制度已迫在眉睫。
