摘要:国内房地产业的发展需要加速资金周转、提高资金使用效率、降低开发成本。基于此,我国的商品房预售制度应运而生。但随着房地产市场的发展,商品房预售制度出现了滞后性。本文首先阐述完善我国商品房预售制度的必要性,接下来分析目前我国商品房预售制度中存在的种种问题,通过借鉴国外商品房预售制度的先进经验,提出我国商品房预售制度的完善措施,从而保障商品房预售主体的权益,以期有益于我国商品房预售市场的健康发展。

Abstract:The development of domestic real estate industry need to speed up the capital turnover,increasing the service efficiency of funds,reducing development costs.Based on this,our residential houses which opens to booking system came into being.But along with the development of the real estate market,the system of Preselling residential housing appeared lag.This paper firstly to elaborate the necessity about the system of preselling residential housing,and the rest of the analysis now the problem about the system of preselling residential housing,through the learning from foreign advanced experience of the system of Preselling residential housing,puts forward the measures to perfect the system of preselling residential housing,so as to safeguard the rights and interests of the presale of commercial residential houses subject,in order to advance healthy development of the presale of commercial residential houses market in China.

商品房预售作为房地产市场中一种新的交易形式,在商品房买卖中倍受关注。所谓商品房预售是指房地产开发经营企业或出卖人将正在建设而尚未竣工的商品房预先出售给承购人,承购人交付定金或者房价款后,在未来确定的日期开发商再将房屋交付给承购人的一种法律行为。为了加强对商品房预售的规范和依法监督,全国人大常委会公布了《中华人民共和国城市房地产管理法》,国务院发布了《城市房地产开发经营管理条例》,国家建设部也发布了《城市商品房预售管理办法》等,初步确立了我国的商品房预售法律制度。自商品房预售制度建立以来,我国不断加强对其的规范化管理,从而保障预购人的合法权益,提升开发商的信誉,使房地产市场走上健康发展之路。
