摘要:随着互联网的快速发展，网络购物逐渐兴起并成为一种时尚，网络购物以其便捷快速的特点走入大众视野，使消费者足不出户就能买到商品。然而，它在给消费者带来便利和实惠的同时，也存在着一些问题，比如商品假冒伪劣、网络诈骗、售后服务缺失等等。网络商家的不合理行为侵害了网络购物消费者的权益，但是目前我国针对网络购物维权的规定并不完善。本文首先分析了网络购物维权救济的必要性，其次，探讨了网络购物维权救济存在的主要障碍，最后，研究国外关于网络购物维权的立法现状，在借鉴国外先进立法经验的基础上，为解决网络购物维权救济问题提出相应的措施。

Abstract:With the rapid development of internet. The network shopping gradually rises up and become a kind of fashion. The network shopping into public view with its convenient fast characteristics. Make consumers never leave households will be able to buy goods. It brought to consumers convenience and benefit, however, it has some problems at the same time. For example，Fake and low-quality commodities, Network fraud, After-sales service recovery, etc. The unreasonable behavior of network businesses infringe upon the network shopping consumers’ rights. It also lack of relevant laws and regulations now. This paper analyzed the network shopping rights the necessity of relief at the first, and then explore the main obstacle of network shopping rights relief. At the last, research the present situation of the rights of legislation about overseas network shopping, on the base of learning from foreign advanced experience, puts forward corresponding measures to solve the network shopping rights relief problem.

在线争议解决方式的发展无疑对网络购物消费者维权救济方面有着重要意义。尽管在线纠纷解决方式的发展在现阶段很大程度上受到了许多因素的制约，但毋庸置疑在解决网络纠纷方面其自身优势不容否定。我国网上解决纠纷实践的匮乏固然和我国电子商务仅处于起步阶段有关系，但是对网上争议解决方式的研究和探讨不够也是一个重要原因。建议我国法学科研和教育机构加强对网上争议解决机制的研究，这样随着网络技术的发展及法律环境的完善，在线纠纷解决方式必定在不久的将来能够得到普及。
