摘要:婚姻是男女两性以永久共同生活为目的，并为当时的法律制度所确认的两性之结合。合法有效的婚姻关系一经缔结，就在婚姻当事人之间产生一系列新的人身关系。这一系列人身关系统称为配偶权。配偶权不仅是夫妻之间权利义务关系的重要内容，而且是公民人身权利的重要内容。配偶权制度的完善程度，不仅反映了一个国家婚姻家庭立法的完善程度，而且体现了一个国家对公民基本权利的重视程度。
然而，我国现行《婚姻法》对配偶权的规定还存在很大的不足，这种状况的存在不利于建立正常的夫妻关系。因此，通过立法完善配偶权制度并建立有效的保护措施，是进一步完善我国婚姻家庭立法的重大课题之一。本文将通过分析我国对配偶权制度的立法现状及不足，探讨如何完善我国的配偶权制度。

Abstract:Marriage is the men and women permanently living together for the purpose of the legal system and then confirmed by the combination of sexes. A legally valid marriage has been concluded in the marriage between the parties to produce a series of new personal relationship. This series of personal clearance system known as the spouse right. Spouse the right to not only an important part of the rights and obligations between husband and wife, and the citizens' personal rights. Spouse the right degree of perfection of the system, not only reflects the degree of perfection of a national marriage and family legislation, and the importance of a national citizens' fundamental rights.
However, the current "Marriage Law" provisions of the spouse's right to exist much to be desired, the existence of such a situation is not conducive to the establishment of a normal marital relationship. Therefore, through legislation to improve the spouses rights system and the establishment of effective protection measures, is one of the major issue to further improve our marriage and family legislation. This paper will analyze China's current legislation on spousal rights system and, to explore how to improve our spouse the right system.
