摘要:近年来关于“小产权房”的法律问题在社会上引起了激烈而广泛的讨论，其折射的社会矛盾和利益冲突是制度性的和深层次的。我国正在完善社会主义市场经济，房地产是其中的一个重要组成部分。小产权房问题涉及国家的土地政策与住房政策，涉及我国现行的相关法律法规，关乎国家耕地保护及居民居住利益保障，关系广大人民切身利益。同时影响社会稳定，因此如何妥善处理好小产权房为现今重要的民生问题。通过研究社会现实存在问题为唤醒相关利益者，同时为决策者提供相关依据与建议，对破解“小产权房”难题有所帮助。

小产权房是在我国特殊的国情和现实背景下产生的。本文以保障民生的角度审视小产权房问题，先后分析了其违法性、危害性及成因，最后提出了处理小产权房的相关对策，认为一方面要保障居民居住权，实现“住有所居”；另一方面要遵守我国法律法规及相关政策，继续坚持国家保护耕地，稳定农业发展，保障民生的政策。
