摘要：中美轮胎特保案在2011年9月5日落下帷幕，世界贸易组织（WTO）裁定中国败诉。文章首先分析了中美轮胎特保案对中国带来的巨大影响：特保案对中国轮胎产业带来了重大冲击，引起了示范性效应，并对中美两国经贸关系带来了影响。其次，文章分析特保案败诉的原因，主要有《中华人民共和国入世议定书》条款不利、WTO规则存在缺陷、美国不承认中国的市场经济地位、行业协会的组织应诉能力不够以及中国轮胎业外贸依存度过高等原因。最后，文章从败诉的原因出发，分析了特保案得到的启示。

Abstract：On September 5,2011 ,the Sino-US tire special safeguard case has ended ,and WTO ruled that China lost.The article first analyzes tremendous influence of the Sino-US tire special safeguard case on China:it has brought a significant impact on the Chinese tire industry,causing a demonstration effect, and affected Sino-US economic and trade relations.The reasons for the lost of the special protective case includes the unfavorable terms from the People's Republic of China on WTO accession protocol,the defective WTO rules; the denial of the status of Chinese market economy by the United States,the lack of the industry associations’ organizing and respondent ability to,as well as the excessive dependence on foreign trade of Chinese tire industry.At the end,the article analyze the inspirations from the Sino-Us tire case based on the reasons for the lost.
