摘 要:二十世纪中期以来，随着世界经济全球化的不断深入和国际贸易的飞速发展，知识产权已经成为国际贸易的焦点，知识产权保护和知识产权贸易已经成为现代国际贸易发展新的趋势，知识产权对一国的国际贸易发展和经济增长的作用日益重要。一国的知识产权保护制度决定了科技水平和生产力的发展，进而决定了该国国际竞争力的强弱，在未来的国际竞争中，知识产权有着决定性作用。
本文主要研究知识产权保护对我国国际贸易的影响及对策，通过研究我国知识产权保护现状、知识产权对国际贸易的影响、我国国际贸易中存在的与知识产权相关的问题，并借鉴发达国家先进的知识产权保护制度和经验教训，分析出知识产权保护对我国国际贸易产生的不利影响的原因，最后总结并提出相应的应对措施、对策。通过本文研究分析认为：知识产权保护对我国国际贸易的影响既有利又有弊，适当的知识产权保护有利于国际贸易的发展；着眼于当前，知识产权保护对发达国家有利，对发展中国家不利；但着眼于长久，知识产权保护对发展中国家和发达国家都有利。面对知识产权保护对我国国际贸易产生的不利影响，我们应该建立国家和企业知识产权战略，完善知识产权法律体系，重视人才培养，正确面对国际贸易纠纷，并积极主动寻找解决纠纷的方法，以维护我国国家和企业的最大利益。

ABSTRACT: Since the middle of twentieth century, with the deepening of economic globalization and the rapid development of international trade, intellectual property has become the focus of international trade. Intellectual property protection and intellectual property trading has become a new trend of modern international trade. It plays a very important role in the economic growth and international trade of a country. The country’s intellectual property protection system determines the level of technology and the development of productivity, and decides the international competitiveness. In the future of international competition, intellectual property plays a decisive role.
This paper studies the intellectual property protection on the impact of international trade and countermeasures. By analyzing the current situation of intellectual property protection, the impact on international trade, the problems between intellectual property and international trade, and learning from the developed countries’ advanced intellectual property protection system and experience, analyze the causes of adverse effects of intellectual property protection on China’s international trade, and finally summarize and propose the corresponding countermeasures. Through this analysis: intellectual property protection on the impact of international trade has both advantages and disadvantages. Appropriate intellectual property protection is beneficial to the international trade. In the short term, intellectual property protection is beneficial to developed countries, but not to developing countries. And in the long term, intellectual property protection is beneficial to both developing countries and developed countries. Facing the adverse impact of intellectual property protection on China’s international trade, we should establish a national and enterprise intellectual property strategy, and improve intellectual property legal system, and pay attention to personnel training, and put the international trade disputes to the right place, and also seek ways to resolve the disputes actively, in order to protect our country and enterprises’ best interests.
