摘要:自从我国改革开放以来,随着房地产管理体制的改革和城市住房制度的改革逐步深入,房地产市场开始全面启动,而物业管理作为房地产行业的伴生行业也应运而出,并且逐步发展成为一个新兴的行业。从1981年我国第一家物业管理企业出现以来,经过种种磨难,走过了三十多年,物业管理行业在改善居民的工作环境、生活环境、扩大就业等方面发挥了积极的作用。但与此同时,物业管理在我国还是属于新兴行业,仍然受到销售水平、传统的观念以及相关的法律法规的滞后等因素的影响,出现了各种各样的问题。而作为南京的一个普通的小区,香槟国际小区的物业管理状况同样不容乐观。
就物业管理公司、业主以及开发商三个方面对香槟国际小区物业管理造成的问题做了问卷调查,发现该小区物业管理存在的问题和矛盾很多,其中包括物业管理服务收费难度大、小区公用部分侵权处理问题、物业管理人员自身素质低、业主自身的问题、及开发商遗留问题、、物业公司缺乏专业人才、业主委员会的作用得不到体现、业主对相关的法律法规不了解等。最后,根据我国的具体国情结合小区的管理现状,提出了一些解决小区物业管理存在的问题有效的方法,如确立业主委员会的法律地位、提高管理人员的自身素质实施管理等等,希望能够使小区的物业管理更加健康和顺利的发展。

Abstract:Since China’s reform and opening up, with the gradual deepening of reform of real estate management system and reform of urban housing system, the real estate market started to develop comprehensively. Meanwhile, property management also emerges as the affiliated industry of real estate industry, and gradually develops into a new industry. Since 1981 when China's first property management enterprise came into being, after experiencing various difficulties and walking for 30 years, the property management industry has played a positive role in the following aspects: improving residents' working environment and living environment and expanding employment, etc. At the same time, property management is still new-arising industry in China and is affected by the factors such as sales level, traditional idea, and relevant law and regulation lag, so it still encounters various problems. As an ordinary community in Nanjing, Champagne International Community also is very serious property management situation.
In the paper, questionnaire investigation is conducted on the property management bureau of Champagne International Community in the following three aspects: property management company, owner, and developer. The author found that the property management of the community has many problems and contradictions, which are shown as follows: it is hard to charge the service of property management, the tort settlement of community public part, property management staffs are low-quality, owner’s problem, the problems left by developer, property company lacks in professional talents, and the function of owner committee cannot be shown, the owner doesn’t know relevant laws and regulations, etc. At last, in light of China’s specific conditions and in combination with community management situations, the paper puts forward some solutions for the problems of community property management. For example, establish the legal status of owner committee, improve management staffs’ qualities, and implement professional management, etc., so that the property management of community can develop healthily and successfully.
