摘要:由于现行的劳动争议处理制度的一些不足之处,不能及时有效的对日益增多的劳动争议案件做出处理,也由此引发出许多问题。本文正是从这些制度的弊端入手,深入分析,以及对症下药,进而对我国劳动争议处理制度的完善提出一些建议。阐述了劳动争议处理制度的四种途径的缺陷及不足。提出了建立集体协商制度,加强工会建设,完善劳动争议调解组织,完善劳动利益争议处理程序的建议。

   本文是要把我国劳动争议处理制度中的问题找出来,并与国外的制度相比较,加以区别。使之更能适应中国的现实国情;是基于一种力图更好协调劳动争议处理制度中各环节之间关系的思路作出的分析。

Abstract:Current, due to the inadequacies of the current labor dispute handling system can not be timely and effective on the growing number of cases of labor disputes to deal with it, also triggered a number of problems. This article is from the start of the drawbacks of these systems, in-depth analysis in order to prescribe the right medicine, and then make some suggestions for the improvement of the labor dispute handling system. This article is to find out the problem should China's labor dispute handling system, and compared with the foreign system to distinguish between. So that it can adapt to the actual situation in China; an analysis trying to better coordinate the various aspects of the relationship between the labor dispute handling system of thinking based on a paper is divided into three parts in discourse:    The first part introduces the concepts and categories of types of labor dispute, an overview of the labor dispute system.    The second part of the introduction of China's labor dispute handling system on the basis of analyzes of the labor dispute negotiation, mediation, arbitration and litigation four system defects and deficiencies, and pointed out that some of the problems solved.The third part is to put forward a sound proposal deficiencies in the system on the labor dispute.
