摘要:随着市场经济体制改革的不断深化,劳动争议调解制度本身存在的缺陷阻碍其在实践中的发挥作用。本文首先提出我国劳动争议调解制度的重要性,通过对当前我国劳动争议调解制度在劳动争议调解机构、三方原则、调解人员素质和调解协议等方面存在的诸多问题进行探究和分析,同时借鉴国外劳动争议调解制度,深入分析提出建立专门劳动争议调解机构、重构“三方原则”、组建专业性的劳动争议调解员队伍、赋予调解协议法律效力等具体措施,在最大程度上保护劳动者权益,缓解劳资矛盾,节约司法资源,促进劳动争议调解制度与劳动关系的和谐发展。

Abstract:With the continuous deepening of reform of the market economy system, labor dispute mediation system defects hinder its play a role in practice. This article first proposed the importance of China's labor dispute mediation system, then explore and analyze the many problems of the labor dispute mediation system in the labor dispute mediation agencies, the Tripartite Declaration of Principles, the quality of mediators and mediation agreements. At the same time ,we learn from foreign labor dispute mediation system, in-depth analysis of labor dispute mediation organization set up specialized, reconstruction “three party principles”, established the professional labor dispute adjuster team, giving the conciliation agreement the legal effect of the concrete measures. The maximum protect worker rights, eliminating the contradiction, save the judicial resources and promote labor dispute mediation system and the harmonious development of labor relations.
