摘要：近年来，离婚案件的数量是逐年上升，在婚姻案件中，所争议的事实就是：是否存在婚姻关系的事实，是否具备构成离婚事由的事实，子女情况的事实、家庭财产状况的事实，双方经济收入的事实。这些事实都是婚姻纠纷中需要证据加以证明的基本事实，这些事实不仅要当事人提出，而且需要拿出证据证明，让法官相信事实的存在。
本文共分为三个部分，首先论述了婚姻案件中所应提供的证据，涉及到了证明夫妻关系的证据，证明感情破裂的证据和证明夫妻共同财产的证据以及证明孩子抚养权的证据。其次指出证人证言、视听资料等在婚姻案件中实际运用中出现的问题。最后提出对证明力的制度构建提出自己的意见。

Abstract:In recent years, the number of divorce cases is rising year on year, in the marriage cases, the argument that: the fact that the existence of marriage, whether the reasons for divorce with the fact that the situation of children, the fact that the situation of the family property, the fact that both the economy the fact that income. 在婚姻案件中，提供具有证明力的证据是至关重要的问题，在证据的收集方面，要明确各种证据的特点，熟知我国相关法律规定，在日常生活中，当事人收集的不具有证明力的证据的问题是屡见不鲜，于此同时更容易侵犯他人的合法权益，为了减少这一现象的出现，本人提出了自己对婚姻案件中证据的证明力的考量问题。通过以上论述，对婚姻案件中的证据进行分析和研究，阐述婚姻案件中当事人收集的证据的证明力问题，为了减少或避免这些问题的存在，明确了在婚姻案件中易减弱或失去证明力的问题。其目的就是希望完善我国有关证据的证明力的规定，提高当事人收集证据的效率，减少司法活动中司法资源的浪费。
