摘要:本文首先从国际恐怖主义犯罪入手，讨论过去各国所发生的恐怖主义犯罪以及反恐斗争的必要性，以便对当前国际社会的反恐行为做进一步的分析。其次厘清打击恐怖主义犯罪和人权保护的关系，明确反恐的终极目标是保障人权。文章进而分析反恐措施侵犯人权的情形，寻求在打击恐怖主义犯罪和保护人权之间保持良好的平衡。为达到这一平衡，各国应在联合国的主导下，在采取多角度、全方位的反恐措施的同时充分尊重和保护人权。最后笔者针对当前我国的反恐现状，认为应修订好反恐与人权保护的立法，避免伤及无辜，在维护公共秩序与保障人权的基础上对我国现有的反恐对策提出完善建议，以期回应当下我国反对恐怖主义和兼顾人权的需要。

Abstract:This paper from the international terrorism crime, discuss past the terrorism crime and the fight against terrorism is necessary, in order to current international anti-terrorism act to do further analysis. Secondly, to clarify the fight against terrorism crimes and human rights protection, clear terrorism is the ultimate goal of safeguarding human rights. This paper then analyses of counter-terrorism measures human rights situation, seeking in the fight against terrorism crimes and protection of human rights to keep a good balance between. To achieve this balance, countries should, under the auspices of the United Nations, taking much angle, all-around counter-terrorism measures at the same time the full respect for and protection of human rights. Finally, the author in view of the current our country 's current situation, think should be revised good anti terrorism and human rights protection legislation, to avoid hurting the innocent, in the maintenance of public order and the protection of human rights in China on the basis of existing anti-terror countermeasure proposals, in order to return to China to fight terrorism and consideration of human needs.
