摘要:随着中国社会的转型，传统乡土社会结构的打破，人们对婚约彩礼的理解呈现出一种多元化趋势，加上我国法律对婚约彩礼问题一直未加以规范，审判人员对解除婚约后彩礼返还问题规定比较主观，给司法实践带来了很大的自由裁量的空间，引发种种问题，因此亟待解决。本文将在详尽分析论证彩礼的发展及其作用和特征的基础上，全面剖析我国现阶段关于婚约彩礼返还中存在的具体问题，重点论证解决彩礼返还问题的法律对策并提出寻求符合我国经济建设和文化发展及顺应世界潮流的理想中的彩礼返还制度建议。

我国自古以来婚姻的缔结，就有男方在婚姻约定初步达成时向女方赠送聘金、聘礼的习俗，这种聘金、聘礼俗称“彩礼”。在中国老百姓心目中，彩礼是吉祥物。送彩礼作为中国民间老百姓订婚礼的重要内容，是老百姓民事生活中的大事。在原本的乡土社会里，因彩礼而产生的纠纷并不多。人们约定成俗：如果男家解除婚约，彩礼不退；如果女家解除婚约，彩礼就要原数退还,大家都恪守习俗。可是，随着中国社会的转型，尤其是改革开放以后，随着人口流动，人们对原本没有歧义的习俗，现在各有各的理解。加上各地的风俗习惯不同，法官道德评价标准的差异，直接导致此类案件处理结果悬殊各异，同案不同判的现象屡见不鲜，严重影响着人民法院判决的公信力。因此，研究彩礼返还过种中出现的问题，寻求出解决问题的法律对策是我们顺应社会潮流的必经之路。
