摘要:目前家庭暴力在我国还是被忽视的一个问题。无论是从人们的思想观念还是立法研究来说，家庭暴力都没有得到重视。对家庭暴力的研究，不仅体现了对于受害者的关怀，更体现了对于他们人权的尊重。本文通过对我国家庭暴力现状、特征及危害的分析、研究和论述总结出我国家庭暴力现象难以遏制的法律因素，进而提出解决该问题的立法对策，致力于在家庭生活领域实现人与人之间的平等与相互尊重，使社会更文明和谐。

Abstract:At present domestic violence in China also ignored the problem. Both from people's ideological concepts and in the legislative studies, domestic violence did not get attention. Study on domestic violence, not only for the care of victims, but also respect for their human rights. This article on China's domestic violence situation, characteristics and damage analysis, research and discussion of family violence in China contain summarized the legal factors, and proposed solutions to the problem of legislative measures, are committed to family life to achieve equality and mutual respect between people and people, making the society more harmonious civilization.

家庭暴力引发违法犯罪的事例并不罕见。有一些妇女生活在长期的暴力阴影之下无法解脱，绝望之中选择了“以暴抗暴”的极端方式。有少数未成年子女由于长期生活在暴力环境之中选择了杀死父母的极端行为，如浙江省某学校一高中生因母亲对自己学习成绩不满长期责怪打骂怨恨，手持榔头将亲生母亲杀死；贵州省一对双胞胎姐妹对家长长期打骂并多次锁在家中不满，采用投毒的方法将父母双亲杀死，父母因教育方法简单粗暴，长期使用暴力使未成年受害人不堪虐待将家长致死的犯罪案件举不胜举。还有部分未成年子女因对家长的暴力行为恐惧和憎恶而不敢或不愿回到家中，浪迹社会受不良感染导致违法犯罪的问题更是令人痛心，这既是家庭的悲剧，也是青少年违法犯罪突出的原因之一。
