摘要:公权力的运行规则是:凡法律没有授权的,行政机关不得为之,法律所禁止的更不得为之。依照法律的规定,每个行政主体的权力都有一定的地域、事务、程度、层级权限的限制,行政行为在运行的过程中超越这个限制就可能侵犯其他行政主体的权力,构成行政越权。但是,我国社会主义法制体系的形成,未能与转型期的经济快速发展带来的种种社会问题和矛盾无缝连接,致使我国依法治国的基本方略受到阻滞。因此,本文以国家转型期政府职能转变和行政体制改革进程中,政府“越权行事”的现象为切入,浅析政府于特定时空背景下“越权行事”现象的法律思考,进而浅梳建设社会主义法制体系之行政体制的完善之道。

Abstract:The rule of public power is that the administration agency can not do the thing which does not authorized by law. What the law prohibits we can not do. According to the legal rules, every administrative subject’s power are restricted of regional, transaction, extent and the authority of hierarchy. In the process of operation, administrative action beyond this limitation may lead to invasion to invasion the power of the other administrative subject, which is called administrative excess of power. However, the formation of the socialist legal system can not connect with the social problem of the economic development, so that our basic strategy of ruling the country by law is subjected arrest. Therefore, the article centering on the phenomenon of excess of authority by the reformation of government’s function and administrative system, analyze the legal consideration of excess of authority in the social transformation period to combing the method to build the administrative system of socialist legal system.

对于行政越权在我国不仅是学术界有较大的争议,而且在立法上也不明确、具体,这种情况必然会导致实践中的混乱。我国应当尽快完善行政组织法律制度,在行政组织法中应当对行政主体之间的关系做出明确具体的规定,做到行政主体之间的关系法定化、明晰化。只有这样才能避免实践中因行政主体之间的关系不明确(如领导关系、指导关系的法定含义是什么?目前法律没有规定。)而不断发生纷争。法律对行政越权做出明确、具体的规定,才能够提高行政效率,保证国家行政权力的有效行使。
