内容摘要：随着我国社会现代化交通工具的日益普及，交通事故频繁发生，严重危害了人民群众生命财产安全。因此，对交通肇事罪有必要进行深入细致地研究。这其中，交通肇事逃逸行为不但是交通事故死亡率明显上升的重要原因，而且是具有较大争议性的重难点问题。如何更好地预防和惩治交通肇事逃逸行为，成为当前刑法学界的热门话题之一。
交通事故发生后，作为肇事者有抢救被害人、接受事故处理的法定义务。某些肇事者未履行此种义务，甚至积极逃避履行义务，给被害人及社会造成不可弥补的损失，同时，也给交通事故的处理带来极大的困难。为惩治这种恶劣行径，刑法规定对交通肇事后逃逸或者逃逸致人死亡的，以交通肇事罪的加重情节加重其法定刑。交通肇事后逃逸即指明知自己的行为造成了交通事故，不履行法定的抢救伤员与财产、报案、接受处理的义务，为逃避法律追究而逃离事故现场的行为，这种行为本质上在于发生交通事故后的抢救义务和事故责任的逃避。离开事故现场的行为是否属于交通肇事后逃逸？就其本质进行分析，逃逸致人死亡即指在发生交通事故后，肇事者不及时抢救被害人而是逃离现场致使被害人因抢救不及时而死亡，虽名曰逃逸致死实则为不履行抢救义务而致被害人死亡。在交通肇事后逃逸致死的认定上，除应把握遗弃致死的实质外，还应对逃逸与死亡结果之间的因果关系予以肯定。

Abstract: With the growing popularity of China's social modernization of transport, traffic accidents occur frequently, seriously endangering the safety of people's lives and property.
