摘 要：实行土地用途管制制度，是我国土地管理体制的一次重大改革，是合理配置和有效利用土地资源的重要手段。本文借鉴国外和我国台湾地区实行土地用途管制的理论和实践经验，研究了土地用途管制制度的内涵及其在土地利用总体规划中的意义和作用，并针对我国在实施土地用途管制制度的过程中存在的难点与问题，从实施管理和立法等角度提出落实土地用途管制的措施与建议。分析结果表明，土地用途管制的实施能够有效保护耕地，实现土地利用总体规划的生态效益；满足总体规划刚性和弹性的要求；消除土地利用的负外部影响；促进总体规划的实施；实现土地资源的可持续利用。但我国的土地用途管制还存在一些问题，需要加强相关立法支撑，制度保障，以及技术等方面的支持。

Abstract: The implementation of land use control is a significant reform of China’s land management institution and an important means of properly allocating and effectively using land resources. Drawing lessons from the theoretical and practical experiences of implementing land use control in foreign countries and Taiwan Region, this article studies the connotation of land use control institution as well as its importance and effect in general land use planning. Based on the difficulties and problems in China’s land use regulation, some measures and suggestions are put forward to further implement land usage regulation from angles such as management, legislation, and so on. According to the analysis, the implement of land use control can effectively protect arable land and thus realize the ecological benefits of general land use planning, meet the rigid and flexible demands of general planning, eliminate the negative outer impacts in land use, promote the practice of general planning and achieve sustainable use of land resources. However, problems still exist in China’s land use control, which need to be solved by strengthening support in legislation, system, technology and other aspects.
