摘要:随着我国金融业的飞速发展,金融产品与金融服务的创新不断增加,金融消费者群体也日渐发展壮大。金融产品和服务具有无形性、复杂性、信息不对称性,以及金融商品、服务信息披露不充分等,加上消费者金融知识水平低等原因,使得现实生活中金融消费纠纷呈现出日益上升的趋势,所以我国金融消费者权益受侵害的问题也逐渐被关注。现今我国对于金融消费者权益保护的立法与监管机构远远落后于金融业的迅速发展,因此加强金融消费者保护已成为金融业发展的必然趋势和迫切需求。所以,本文对我国金融消费者保护问题进行初步探讨,找出我国就目前金融服务及其监管中存在的一些问题。通过对各国的相关立法与现有研究成果比较,提出适合我国的金融消费者权益保护的建议。比如可以制定一部专门的法律来作为保障消费者权益的基础,以此来完善其他相关的法律;对金融监管机构的消费者保护职责做出明确的规定;健全消费者的救济途径,维护消费者的合法权益;加强行业自律组织的建设,不断健全和完善自律机制;进行消费者教育,提高他们对金融知识的理解,也提高他们的维权意识。

Abstract:With the rapid development of domestic financial industry, there are an increasing number of innovations of financial products and services, and there are more and more financial consumers. Financial products and service is complex and invisible, and the information is asymmetrical in the transaction. In addition to this, the disclosure of information is inadequate, coupled with the low level of consumer financial literacy, financial consumption disputes showing a rising trend. So the problem on consumers’ rights and interests being infringed have been concerned. The rapid development of China’s financial consumer protection legislation and supervision mechanism falls behind China’s financial industry, so it is necessary to strengthen consumer protection. Therefore, this paper makes a preliminary research into the issue of financial consumer protection in our country and find out our problems existing in financial services. By comparison of the legislation and the research results, we strive to find out the system of financial consumer protection for our country. Such as financial consumers at present there is a special legal protection, the financial services of consumer protection can be used as a basis, to other related laws. The financial supervision mechanism of responsibility for consumer protection should be made clear. We can improve the way of relief to protect the lawful rights and interests. We can strengthen the construction industry self-discipline organization and establishment and improve the mechanisms of self-discipline. We can educate the consumers, enhance their knowledge of financial and raise their awareness of the adults.
