摘要:随着经济全球化的发展,信用证在外贸实践中发挥着越来越重要的作用,其作为一种较为安全的支付方式,得到越来越多的青睐,但是软条款的出现给外贸活动带来很多风险。在很大程度上,软条款是进口商为了保证自身的利益不受侵害并掌握外贸活动中的主动权而产生的,它作为隐藏在信用证中的陷阱往往会导致出口商遭遇钱货两空的的局面,其多样的形式和不易发觉的特性更要求企业在外贸活动中提高警惕,本文通过案例分析企业在外贸实践中面临的软条款风险及如何有效的自我防范。

Abstract: With the development of economic globalization, the practice of letter of credit in foreign trade is playing an increasingly important role. As a more secure method of payment, the letter of credit become more and more popular, but the soft clauses of foreign trade activities bring a lot of risks. To a large extent, the soft clauses to importers in order to ensure their own interests and grasp the initiative in foreign trade activities. It as hidden in the credit trap often cause exporters to encounter the situation of no money or goods. Its characteristics of different kinds and difficult to find require enterprises enhance vigilance in the foreign trade activities. This paper analyzes the risk of soft clauses and how to self-protection effectively for the enterprises through the cases in the foreign trade activities.
