摘要：科技改变生活，互联网的出现在为人类提供全新生活方式的同时，也催生了“虚拟财产”这一新鲜事物。自虚拟财产出现以来，其交易纠纷就频繁地发生，这已经引起人们的广泛关注。由于虚拟财产还是个新事物，因此在理论上对虚拟财产的定性分析还不明确，在实际生活中也没有确实可行的操作方法，进而导致对网络虚拟财产交易的法律保护成为了法律难题。本人借鉴相关学者的研究成果，对网络虚拟财产理论作初步探究。在这个基础上，针对网络虚拟财产的交易形式，参考国内外的立法经验，尝试性的来寻找网络虚拟财产交易纠纷的预防、解决机制，为网络虚拟财产交易相关的立法与司法提供借鉴作用。

Abstract：Science and technology have changed the way of our life , Internet this tremendous outcome of the computer net- works nowadays has provided a brand-new life-style and thus hastened the birth of the newly-popped virtual property . The virtual property in the trade disputes as frequently happens, this has aroused extensive concern. Since virtual property still a new thing, so in theory, qualitative analysis of virtual property is not clear, in real life there is no practicable method of operation, which led to the virtual property transactions, legal protection has become a legal problem.I draw on relevant research results, the theory of virtual property as a preliminary inquiry. On this basis, for the form of virtual property transactions, reference to domestic and foreign legislative experience, try to find a network of virtual property trade dispute prevention and resolution mechanism for the network virtual property transactions to provide the relevant legislative and judicial reference.
