摘要:本文以研究媒体舆论监督与司法独立的理论基础为突破口，进而探求出两者之间存在既相互对立又相互统一的辩证关系。在此基础上，提出建立两者和谐关系的努力方向以适应中国特殊的国情，希望在两者之间能够建立一个利益平衡和促进机制，使两者形成良性互动博弈机制，从而为我们的法治建设贡献力量。

Abstract:This paper studies the theoretical basis of the media supervision by public opinion and the independence of the judiciary as a breakthrough, and then to explore between both antagonistic and mutually unified dialectical relationship. On this basis, the efforts to establish a harmonious relationship between the two directions to accommodate the special circumstances of China, hoping to establish a balance of interests between the two and promotion mechanisms, so that the two positive interactive game mechanism for our rule of law contribute.

解决媒体监督与司法独立的冲突，一般认为是应如何把握合理的度，但在确定这个度时，必须在尊重新闻自由和司法公正这两种价值的前提下兼顾考虑其他因素，这是一个十分复杂而且重要的问题。对此问题的考虑我在上述论述中比较粗略的阐述了一下，主要就是从司法与媒体两方面入手，加强媒体监督和司法独立自身制度的建设和完善，同时使两者互相支持，互相促进。其最终的目标就是:“在维护社会统治总体目标的前提下，媒体与司法各自保持相对独立的立场，媒体具有依据自身立场论说和评价司法行为及司法过程的权能，媒体地位既不在于代表某一方面利益对司法持简单的批判态度，也不应完全遵从司法机构的意志，传达司法机关的声音，其地位是独立并相对超脱的。”
