摘要:随着我国的经济发展，我国公益捐赠法律制度滞后于经济发展，制约着公益事业的发展。本文首先提出对完善公益捐赠制度的重要性，通过对我国公益捐赠法律制度在公益捐赠的立法层面、配套的法律法规、政府的地位作用和公益组织的管理等方面存在的诸多问题进行了探究和分析。针对这些问题，借鉴国外该制度的优点，提出了完善公益捐赠立法、完善配套法律法规、明确政府在公益捐赠中的地位和加强对公益组织的监督管理等具体措施，以期有效完善公益捐赠法律制度，并促进我国公益事业的发展。

Abstract:With our country economic development, our country the legal system of public welfare donation lags behind economic development, restricting the development of public welfare. This article first proposed on the importance of perfecting the system of public welfare donation. The donation to the legislative level, supporting laws and regulations, the status and role of government and public interest organizations, many of the legal system of public welfare donation to explore and analysis. Solve these problems, learn from abroad. This article put forward perfect public welfare donation legislation, improves the supporting laws and regulations, clearly government’s position in the public welfare donation, strengthen public interest organization supervision and management specific measures. Improve the public welfare donation legal system of the specific measures in order to effectively improve the donation to the legal system, and promote the development of China's public welfare.

关于公益捐赠，目前没有确定统一的定义。一般认为，公益捐赠是指为了公益或者公共目的所为的无偿给予。我国《公益事业捐赠法》对于公益捐赠的定义是:自然人、法人或者其他组织自愿无偿向依法成立的公益性社会团体和公益性非营利的事业单位捐赠财产，用于公益事业的。公益捐赠对公益事业的发展有着重要作用，但是我国公益捐赠法律制度还存在着缺陷。公益捐赠立法层次低、没有完善的配套法律法规、政府的作用过大且监督不健全、公益组织管理不完善等问题存在。为了让公益事业更好的发展，我国公益捐赠法律制度尚需完善。
公益捐赠是公益事业发展的重要行为方式之一，是公力救济的必要补充。公益事业在取得成绩的同时也面临着挑战。现今我国公益事业处于初步发展的阶段，在公益捐赠的立法层次、公益捐赠法律法规、公益组织的内部管理、政府的管理监督等方面都需要进一步完善。该制度的缺陷在一定的程度上阻碍公益事业的健康发展。加上我国不时发生一些自然灾害，如南方雪灾、汶川地震、玉树地震等，在公益捐赠的过程显露出一系列的问题，诸如救灾的物资被挪用、捐款或者物资的使用情况不明、信息披露不透明等。这些问题不利于公益事业的发展，要使公益事业健康发展需要良好的环境，需要完善公益捐赠法律制度。要充分发挥公益捐赠的在社会主义建设中的作用，要尽快完善公益捐赠法律制度。因此，完善我国公益捐赠法律制度尤为重要。
