摘要:正当防卫是法律赋予公民的一项权利，国家不仅运用社会主义法制同违法犯罪行为作斗争，而且从道义上和法律上鼓励和支持人民群众依法直接同一切不法侵害国家、公共利益、公民的人身、财产等合法权益的行为作斗争。然而，随着社会的发展，违法犯罪行为手段的演变，当前正当防卫制度的不足之处也日益显露出，为了更好地保护公民的合法权益，必须正确认定正当防卫，切实保护正当防卫行为，正确执行正当防卫制度。于是，进一步完善正当防卫制度，值得我们研究和探讨。笔者通过对正当防卫的析义，从其司法实践、对公民的保护方面深入研究，对完善正当防卫制度提出具体的设想。

Abstract:Self-defense is a right of citizens, our country not only using socialist legal system to fighting with criminal acts, but also according to the law to encourage and support people fighting with all criminal violations directly to the Country, the public interest, rights of the person, property and other legitimate rights and interests from a moral and legal. However, with the development of society, self-defense system’s shortage is revealed by means of criminal acts have been changed. In order to protect the legitimate rights and interests of citizens, we must identify self-defense correctly, protect it effectively and perform it correctly. Therefore, it’s worthy of our research and discussion to improve the self-defense system further. The author through analyze self-defense ，which from its judicial practice and the protection of citizens in-depth research. Put forward some suggestion to improve the system of self-defense.
