摘要：交通肇事逃逸行为是交通肇事罪中的多发现象,是一种严重危害公共安全的行为。《中华人民共和国刑法》和《最高人民法院关于审理交通肇事刑事案件具体应用法律若干问题的解释》关于“逃逸行为”的规定,在实践中出现了一些概念上的误解和做法上的偏差,成为刑事司法与理论关注的焦点。有鉴于此,本文从我国现行立法及司法实践方面指出研究交通肇事逃逸行为的必要性，再分析我国交通肇事犯罪立法上存在的问题，通过对交通肇事逃逸行为、因逃逸致人死亡等问题进行研究,比较国内外对交通肇事逃逸行为的处理方式，借鉴国外及我国台湾、澳门地区的立法，提出完善我国交通肇事罪中逃逸行为的法律构想。

Abstract：Traffic hit and run traffic accident acts are crimes in multiple phenomenon, is a serious act of endangering public safety. "riminal Law" and "Supreme People's Court to hear the traffic accident on the specific application of the law in criminal cases, the interpretation of a number of issues" on the "escape behavior" and provides that in practice, there have been some misunderstanding on the concept and practice of the deviation, as Criminal Justice and theoretical focus of attention. In view of this, this article from our current legislation and judicial practice that the study of the need for escape behavior of the traffic accident, and then analyze the the problems of Chinese traffice accident’s legislation.Put forwards Chinese law of the traffice accident by studying the escape behaviour of the traffic accident,killing people because of escaping,comparing the treat manner with other countries,referencing legislation in other countries and Taiwan and Macao.
