摘要：当前，我国道路交通安全形势相当严峻，交通肇事逃逸行为有增无减，给人们的生命、安全造成极大威胁。交通肇事后逃逸行为是近年来法学界争论的一个焦点问题，然而我国关于交通肇事中的逃逸行为无论在理论上还是实践上都存在不少争议问题。德国、日本、瑞士等国关于交通肇事逃逸行为的罪名设置给了我国刑法的完善提供了方向，我国刑法应借鉴外国的做法，再结合本国的国情进行修改和完善。本文提出了修改现行交通肇事罪，将交通肇事逃逸从交通肇事罪中分离出来，单独设立交通肇事逃逸罪的刑事立法完善构想。

Abstract：At the present, situation of traffic safety in China is quite severe. The escape action in traffic accidence, which is being seen more and more, cause serious threat to people’s life and safety. The escape action after causing traffic accidence is a key problem to be discussed in law theory field in recent years, but there is quite a few dispute in our country, no matter in theory or in practice, about the escape action in traffic accidence. Definitions of crime of escape action in traffic accidence in Germany, Japan and other countries give us direction to improve criminal law in our country. We should take their work as reference and make amendment and improvement in accordance with the national characteristics of China. This article supplies improving proposals to amend the current criminal legislation for the traffic accident crime, to separately set a crime for absconding after causing traffic accident.
