摘要:中国是农业大国，农村问题在社会经济建设中处于核心地位，关注当代中国就必须关注农村。对农村的关注不可避免的要涉及农村社会纠纷的解决。人民调解制度源于我国传统的调处止息制度，是具有中国特色的非诉讼纠纷解决方式。与其他方式相比，人民调解具有灵活性，民间性等特点，人民调解对于我国农村的稳定发挥过举足轻重的作用。但是，随着中国社会进入转型期，农村地区的纠纷呈现出主体多元化、类型多样化、法律关系复杂化的特点，原有的人民调解机制已无法适应现代化的需要，造成人民调解在纠纷解决中的比例逐渐下降，解纠功能弱化，并有没落的迹象。面对日益频繁的农村社会纠纷，深入研究人民调解，完善人民调解制度对于解决农村社会纠纷，稳定农村社会具有重要的现实意义。

Abstract:China is a agricultural country, rural problems in the construction of social economy in a core position, pay close attention to contemporary China must focus on rural areas. The attention to rural inevitably involves rural society dispute resolution. System of people's mediation system is the result of our traditional mediation fails, with Chinese characteristics is of non-litigation dispute resolution. Flexible compared with other methods, the people's mediation, the folk characteristics of the people's conciliation for stability played an important role in the rural areas. However, as China's rural social transitional period, and presents the diversification of the dispute, diverse types and characteristics of legal relation is complicated by the original have been unable to meet the needs of the modern people's mediation mechanism, caused the people's conciliation ratio decreased gradually in the solution of disputes, solutions for remedy function weakened, and there are signs of decline. In the face of increasingly frequent social disputes in rural areas, in-depth study of people's mediation, perfecting the system of people's mediation to solve rural society dispute, stability of rural society has important practical significance.

转型期的农村社会矛盾突出，纠纷频发，且纠纷呈现出多元化，复杂化的驱使，这必然导致纠纷解决机制的多元化。“中国的法治之路，必须注重利用中国的本土资源，注重中国法律文化的传统与实际”[18]。人民调解制度作为我国传统的纠纷解决机制，在解决纠纷实践中发挥了重要的作用，展现出了巨大的潜力，是构建多元化纠纷解决机制的理想选择。创新和完善农村人民调解制度，对于及时化解矛盾纠纷，维护社会稳定、促进我国农村地区社会经济的协调发展具有非常重大的意义。
