摘要：随着现代战争对空间依赖性的增强,外层空间对人类的未来具有重大的价值，各大国为争霸世界，正在太空展开激烈的军备竞赛。为限制外层空间军事化，国际上出台了相应的空间法律、法规来约束、限制这种行为，各主要外层空间条约均规定了探索利用外空的“和平目的”原则，但由于国际空间法本身存在一定缺陷以及其他国家对国际空间法有不同态度，这种约束力表现得明显不足。本文通过对国际空间法的研究，指出了国际空间法存在的问题，分析了在国际空间法有限的制约范围内外层空间军事竞赛的发展趋势。笔者认为：限制外空军事化和外空军备竞赛，完善现有国际空间法，修订顺应时代需要的空间法已是大势所趋。

Abstract：With the reinforcement of depending on space in modern wars，the outer space has vast value on the development of the human being’s future, the superpowers are carrying on fierce military contest in the outer space in order to dominate the world．To limit militarization in outer space，some International Space Laws have been enacted corresponding1y，most Outer space treaties provide the principle of“peaceful purpose”during the exploration and use of outer space．But because these International Space Laws have some limitation and different country has different attitude to these 1aws，the sanction of these laws is evidently poor．This thesis by researching on International Space Laws，the paper points out the problems of International Space Laws，analyses the developing trend of space military contest in the restricted range of International Space Laws，and educes that to limit militarization and arms race in outer space，it’s a trend to perfect the existing International Space I was and constitute new ones what the time needs．
