摘要：我国对商业秘密的保护起步较晚，尽管在民法保护方面、刑法保护方面、竞争法方面都有所发展，但民法保护上却依然存在着一定的不足。商业秘密作为一个企业的无形资产，为企业带来了可观的经济效益，同时也带来了市场竞争力，而随之导致了一些不法之人为了个人私欲或者商业竞争而实行窃取他人商业秘密的行为，进而产生了商业秘密的保护，尤其民法是商业秘密法律保护的重要一环，我国在商业秘密的民法保护这一块上的立法并不完善，为了维护正常的市场竞争秩序以及维护商业秘密权利人的合法权益，商业秘密的民法保护方面急需改善，本文即从这方面展开，阐述应如何对民法中商业秘密的保护进行改善。
