摘要:随着科技的发展，信息的记载方式从传统的纸面记载走向了数字化、现代化。网络的出现带来了新的信息传播的方式，著作权保护受到了新的挑战。我国已先后出台了若干法律规范、司法解释和行政规章。这些法律、行政法规、司法解释等在各自的适用领域内均发挥着重要作用。但相对于日新月异的网络技术发展而言，我国现有的网络环境下著作权保护法律体系仍然存在诸多不足。
网络的全球性、虚拟性、无界性，导致网络领域的侵权行为有其特殊之处，决定案件管辖的因素也会有不同的特点。传统的侵权案件的管辖规范已不能很好地适用于网络著作权侵权案件的管辖问题上。网络作品具有精密性、脆弱性、抽象性、多媒体性，这给取证带来了不少困难。因此，对国内外网络著作权制度进行深入了解和对比，提出完善我国网络著作权制度的建议。

Abstract:With the development of science and technology,information record method from the traditional paper records to digitization,modernization. The appearance of the network brings new information dissemination way. Copyright protection is a new challenge. China has successively promulgated a number of laws and regulations,judicial interpretations and administrative regulations. These laws, administrative regulations, judicial interpretations in their application in the field of all played an important role in. But relative to the network change rapidly in terms of technical development,our country's existing copyright protection under network environment legal system still has many deficiencies.
The global network,virtual,unbounded,led to the field of network tort has its particularity， determining jurisdiction factors also have different characteristics. The traditional tort law case jurisdiction standard is not very well suited to the network copyright infringement case jurisdiction problem. Network works with precision,vulnerability,abstraction, multimedia,which give evidence brought a lot of difficulties. Therefore,the domestic and foreign network copyright system in-depth understanding and comparison,proposed consummates our country network copyright system.
