摘要:随着我国人口老龄化的加剧，完善的养老保险制度对解决人口老龄化带来的问题起着越来越重要的作用。本文首先分析我国养老保险制度的意义,说明养老保险制度的重要地位，同时通过借鉴世界其他国家的经验，从我国养老保险制度的现状中，指出了我国养老保险法律制度存在的问题，并在此基础上，针对这些问题提出了完善的建议。

Abstract:This paper discusses the legal system in China's endowment insurance, the significance of endowment insurance system that the important position, and drawing on the experience of other countries in the world, from the present situation of China's endowment insurance system, it is pointed out that China's endowment insurance of the deficiencies, puts forward the necessity of endowment insurance needs to be improved on China's endowment insurance system of the reasonable construction exploration, and on this basis, points out that the legal system of China's endowment insurance issue of the perfect recommendations.

养老保险的目的是为保障老年人的基本生活需求，为其提供稳定可靠的生活来源的社会保障制度。随着我国人口老龄化的逐渐到来，我国老年人口的比例越来越大，老年人数值也越来越多，对于老年劳动者来说，有了健全的养老保险制度，保障了他们的基本生活，相当于保障了社会相当部分人口的基本生活，使得老年人老有所养，安享晚年。
其次，也有利于社会的稳定。养老保险制度的首要作用在于能确保劳动者老有所养，保证劳动者在年老退出生产过程之后能够获得一定的生活保障，从而使劳动者在就业期间能安心的工作，没有养老的后顾之忧。老年人的生活有了保障，也就解除了年青人的后顾之忧，使他们能够安心的工作和劳动。从社会心态来说，人们多了些稳定、少了些浮躁，这有利于社会的稳定以及社会的和谐发展。因此，实行老年社会保障有利于社会的安定团结、代际接替及协调发展。
