摘要：证人法律保护制度的实施有利于保护证人的人身及财产安全，增加证人的出庭率，但是现今我国的证人法律保护制度存在着各种各样的问题和缺陷，致使证人保护在实施上成为空谈。本文通过提出现今证人法律保护制度存在的不足，对存在的问题进行分析，进一步提出解决方法来完善该制度，让证人能更好地履行作证义务，提高证人的出庭率，使犯罪分子得到公平公正的审判。

Abstract:Witnesses the implementation of the system of legal protection of personal and property safety of the witness protection, to increase the rate of the witnesses to appear, but the witnesses legal protection system in China there are a variety of problems and defects, resulting in the witness protection ring hollow in the implementation. This paper proposed the shortcomings of today's witnesses legal protection system, to analyze the problems, propose solutions to improve the system, so that witnesses can better fulfill the obligation of bearing testimony to improve the court of witnesses, so that the criminals get a fair trial.

证人法律保护制度是指证人在履行作证义务的同时，国家对其人身和财产方面提供法律保护，不受他人侵害的一种法律制度。因为现今我国法律在证人保护制度方面还存在许多不足的地方，使该制度在实行方面遇到了各种各样的困难，且证人的各类安全在司法实践中并没有得到很好的保护，使证人不愿出庭作证，以至于在审判中不能很好地做到公平公正。因此完善证人法律保护制度，可以让证人能无负担、无忧虑的出庭作证，不用受到人身、财产及名誉的威胁和伤害，同时也能够捍卫法律的尊严，使犯罪分子得到公平公正的审判。
