摘要:近年来，我国在围绕新闻报道方面出现了大量的侵权诉讼，如新闻侵害民事主体人格权诉讼、新闻侵害民事主体名誉权诉讼等。在此类诉讼中，由于我国新闻侵权行为法律规制问题的模糊性产生了许多纠纷，导致裁判的结果往往不能平衡双方利益的得失。为了更好的协调新闻自由与公民人格权利之间冲突，完善我国新闻侵权行为的法律规制问题已经是一个不可避免的课题。本文首先提出完善我国新闻侵权行为的法律规制的必要性，然后对我国新闻侵权行为法律规制中存在的主要问题进行分析，同时通过借鉴国外对新闻侵权行为法律规制问题的经验，提出完善我国新闻侵权行为的法律规制问题的对策，进而更加有效的保护当事人的利益，并促进我国经济社会的持续、健康的发展。

Abstract:In recent years, our country appears a large number of tort litigation around the news report. As news violations civil main body personality right lawsuit, news civil subject reputation infringement proceedings. In such action, because China's news tort laws regulating the fuzziness of problems produced many disputes, lead to the result of the referee often cannot balance the interests of both parties gain and loss. In order to coordinate press freedom and the citizen rights conflict between personalities, perfect our news infringement of the legal regulations problem has to be an inevitable topic. This paper puts forward to perfect our news tort law regulation of necessity, then on to our news tort laws regulating the main problems existing in the analysis, But at the same time, through to foreign news tort laws regulating the experience, to improve our news tort law regulation the countermeasure of the problem, more effective to protect the interests of the parties, and promote our country economic society of continuous healthy development.

随着我国现今新闻侵权案件数量的增加，造成新闻自由与公民人格权利之间的冲突日益加剧。在现实生活中，常常出现新闻工作者通过新闻媒体向社会公众传播不真实的内容，或是内容虽然真实但属于法律禁止传播的事项，从而侵害了他人的合法民事权利，依法应当承担法律后果的行为和事实。而我国新闻侵权行为法律规制制度的缺失导致在司法实践中不能对新闻侵权行为进行很好的追责。因此研究我国新闻侵权行为的法律规制问题具有十分重大的理论价值和实践意义。
