摘要:安乐死一词自出现以来便一直是一个热点话题。很多国家都对安乐死有了明确的立法，在我国，虽然安乐死的研究早在上个世纪末已展开，学者们以是否应承认安乐死为主题做过多次民意调查，也曾提起关于安乐死的议案，但是我国目前还未建立安乐死的相关制度。由此可见，将安乐死合法化是一项刻不容缓的任务，承认安乐死不仅是社会文明进步的体现，更是推进司法实践发展的必然要求。笔者认为,应从立法上承认安乐死的合法性，区分安乐死与刑事犯罪，制订安乐死的具体实施方案，构建安乐死的监督体系。

Abstract:The word euthanasia has been a popular topic since it came out. Many countries have implemented specific policies regarding euthanasia. In China，researches about euthanasia have been started at the end of last century，experts poll many times on whether euthanasia should be admitted and offer many different proposals for euthanasia．However，China still does not implement any policies related to euthanasia．We can see，legalization of euthanasia is an urgent task．Euthanasia should be legal because admitting euthanasia not only shows the progress of social civilization，but also the requirement of boosting the development of juridical practice. In my point of view，it is necessary to recognize legislation what the legality of euthanasia，the distinction between euthanasia and criminal offences，developed the practical implementation of the programme of euthanasia and construction supervision system of euthanasia．

安乐死合法化是有其客观必要性的，在社会不断发展的今天，我们的法律应该与人们的日常生活相适应。安乐死的立法问题亟待解决，国外关于安乐死的立法，有判例法、习惯法、成文法等。由于安乐死问题关系到至高无上的人的生命，因而需要由国家立法予以严格规定。目前，安乐死在我国尚未立法，然而安乐死要在我国变成合法行为就必须对其进行立法，将安乐死合法化，是填补我国法律漏洞的一种途径。确定安乐死的相关问题，在一定程度上推进了我国法制建设的发展。法律存在的实质意义就在于贴近人民的生活、保护人民的合法权利，而生命权作为公民最根本的权利，是最需要得到保障的。承认安乐死，让公民实现“优生优死”，自主选择死亡的方式，不但更好的保护了公民的生命权，也落实了法律应随着时代的发展而变化的要求。充分贴近人民的生存需要，让法律制度随着时代的发展而发展，才能够体现法律存在的意义和价值。
