摘要:随着经济和科学技术的发展,高科技产品在为消费者带来便利的同时,大量缺陷产品也使消费者的人身和财产遭受了巨大的损害。缺陷产品召回制度在当今世界各国特别是发达国家已经普遍建立和实施,而我国目前还没有统一的、独立的产品召回制度,导致我国不能对缺陷产品进行及时有效的召回,不能切实地发挥产品召回制度的作用。本文首先分析了我国当前产品召回制度的现状以及存在的问题,通过借鉴其他国家和地区的先进经验,提出有关完善我国产品召回制度的建议,以期引起社会对此问题的关注,更好地保护消费者的合法权益。

Abstract:With the development of economy and scientific technology, high-tech products for consumer convenience at the same time, a large number of defective products to consumer's personal and property suffered great damage. Defective product recall system in the world especially the developed country has generally established and implemented, but our country still does not have unified, independent product recall system in our country, not to have the defects timely and effective recall, cannot effectively play the role of product recall system. This paper first of China's current product recall system and the status of the existing problems, through drawing lessons from other countries and regions of the advanced experience, put forward the improvement of China's product recall system is proposed, in order to arouse social attention to this problem, a better protection of the legitimate rights and interests of consumers.

完善我国的产品召回制度,能够有效消除各类缺陷产品带来的危及人身、财产安全的不合理危险,维护消费者的合法权益。我国目前有关缺陷产品召回制度的立法进程才刚刚起步,还存在很多法律空白。为此,必须尽快完善我国的缺陷产品召回法律体系,以完善我国的产品召回制度,从而推动生产力和消费关系的和谐发展,推动整个国民经济的持续、稳定和快速发展。
