摘要:目前，我国劳动合同期限分为三种形式：固定期限劳动合同、无固定期限劳动合同和完成一定工作任务的劳动合同。长期以来，我国一直实行以固定期限劳动合同为主导的劳动合同期限制度，自2008年《中华人民共和国劳动合同法》颁布以后，我国大力推行无固定期限劳动合同。这无疑是我国劳动合同期限制度的一个巨大的进步。但是，现时我国《劳动合同法》及其相关制度对劳动合同期限问题规定得并不完备，而且存在缺失与缺陷，如：劳动合同限期制度立法理念不符合合同法原理；模式选择上脱离我国的实际国情；适用范围过宽；解除制度的松紧把握不当等，都导致实践中产生许多问题。因此劳动合同期限制度的完善有着十分重要的意义。以下我通过与法国，德国先进的劳动合同期限制度进行对比与借鉴，总结出来了完善我国劳动合同期限制度的几条建议：更新我国劳动合同限期制度立法理念；选择以稳定性为主兼顾流动性的模式；按照不同的标准来确定劳动合同期限的适用范围；在解除制度上，严格限定固定期限劳动合同的解除条件，放宽无固定期限劳动合同的解雇限制。

目前，世界各国尤其西方发达国家，为了稳定劳动关系，降低失业率，实现人力资源的优化配置，都不断完善立法，推行无固定期限劳动合同制度。但是，现时我国《劳动合同法》及其相关制度对劳动合同期限问题规定得并不完备，主要体现在规定劳动合同期限的条款太少，不够架构起完善的劳动合同期限制度；而且现有的劳动合同期限具体制度也存在缺失与缺陷，导致实践中产生许多问题。
