摘要：“生存尊严”是一个涉及哲学、政治学、伦理学、法学等多学科的概念，它取决于社会物质生活条件，随着物质生活条件和人们的法权要求的发展而发展。从法理学的视角看，“生存尊严”以平等的人权为承载点，“以人为本”是其最高价值，契合了党和政府“以人为本”的执政理念；以人的发展为重心，不断满足人的物质文化需求，是实现“人的价值”的一种资格和权能。“生存尊严”具有自由价值、平等价值、发展价值、利益价值以及和谐价值。其作为一种法律原则，对立法、司法、执法、守法有着引导功能。

Abstract: Living dignity is a concept which relates to many disciplines involve philosophy, politics, ethics, jurisprudence and so on. It’s decided by the material condition of social life. It develops following the progress of the material condition of social life and patriarchy requirements. In the perspective of jurisprudence, living dignity depends on the equal human rights. People oriented is the biggest value it pursues. As a qualification or power for realizing human value, living dignity emphasizes the human development and satisfies the continued requirements of material and culture. Living dignity has the values of freedom, equality, development, profit and harmonization. As a kind of principles of legality, it has the function of leading the ways of legislation, judicature, enforcement and observing the law.
