摘要：随着社会的快速进步和工业化的全面发展，环境污染、环境侵权等问题也层出不穷，各国纷纷提出相应的绿色保险制度来解决该问题。但是近十几年来我国关于绿色保险制度的发展在初步阶段，缺乏经验和数据积累，本文在借鉴美国、德国和日本不同国家的实践经验和先进管理技术的基础上，分析了我国建立绿色保险制度在法律制度、政府、保险公司、企业者的不同角度存在的障碍因素，提出相应的理论建议。这不仅有助于保险市场的发展与完善，还有助于社会生活水平的提高和企业规避风险、转移损失。

ABSTRACT：As the rapid advancement of the society and the comprehensive development of industrialization,problems as environmental pollution and environmental tort emerge in endlessly,many countries comes up with corresponded green insurance system to solve these problems.However,in the past two decades,the development of China's green insurance system is in the preliminary stage,it is lack of experience and data accumulation.In the paper,based on the reference of practical experience in America,German and Japan and their advanced management technology,it analyzes the existing obstacles of China's green insurance system from the perspectives as laws and regulations,government,insurance company and entrepreneur,then it proposes corresponded theoretical suggestions.It is not only beneficial to the development and improvement of insurance market but also beneficial to the improvement of living standards in the society and enterprise's risk-aversion and loss transfer.
