摘要:现实生活中，侵害知名商品特有的名称案越来越多，其仿冒手段也日趋隐蔽巧妙，这种行为严重损害了知名商品生产者、经营者的合法权益，坑害了消费者，扰乱了市场经济秩序。由于我国的知名商品特有标志法律保护制度起步较晚，相关法律法规还不完善。我国对于知名商品的法律保护现状，仅限于反不正当竞争法第五条第二款的规定及与之配套的司法解释，根本不足以应对新形势下出现的不正当竞争行为。故建立一套完备的知名商品特有标志法律保护制度，从近处看，有助于鼓励经营者创造更多财富和维护公平合理的市场竞争秩序；从远的方面讲，有助于提高我国的知识产权保护水平以及提升我国的国际声望。因此，完善我国知名商品法律保护制度有着重要的现实意义。

Abstract:Disput related to marks of famous commodity rushes and the means of pas sing of improves，which creates adverse effect on the benefit of vender，comsu mer as well as market economy. Because of our county legislation for famous c ommodity is started later , so the related laws and regulations aren’t perfect An d our county legislation for famous commodity is provided now in anti-unfair c ompetition, which can not due with the present unfair competition. So establish ed a perfect legislation for famous commodity is important .On the one hand, it help to encourage the vender to create more wealth and maintain the market co mpetition order to be fair and reasonable, on the another hand , it help to impr ove our county’s level of intellectual property protection and increase our cou ntry ‘s international reputation . That indicates that research on famous is valu able on practice.
