摘要:随着我国现代化经济中交通运输业的日益发展，交通肇事罪发生率逐年上升，已成为多发常见性的犯罪，尤其是交通肇事逃逸案件的发生，不仅扰乱了公共交通安全秩序，而且严重危害了人民的生命健康安全和财产安全。交通肇事后的逃逸行为是交通肇事的顺延行为，体现了肇事者具有较为恶劣的主观性，其根本动机就是逃避抢救义务和逃避法律责任。因此，如何处理交通肇事逃逸案件是我国公共交通安全中亟待解决的首要问题。笔者通过对我国关于交通肇事逃逸行为的立法及司法解释所存在的缺陷进行辨析，借鉴日本和我国台湾地区的交通肇事犯罪的立法状况及处理办法，提出将交通肇事逃逸行为从交通肇事罪中单独列出来，增设交通肇事逃逸罪的立法建议。

Abstract:As China's modern economy growing in the transport industry, the crime of causing a traffic a accident increased year by year, has become a common multiple of crime, in particular, the occurrence of hit and run cases, not only disturbed the public order and traffic safety, but also seriously jeopardize the health and safety of people's lives and property. Therefore, how to deal with traffic hit and run cases in China's public transport safety is the primary problem demanding prompt solution.
