摘要:近年来，我国市场上的商业贿赂现象较为严重，它进一步发展成为部分行业的市场“潜规则”。 一些企业已经成为商业贿赂的温床，因而步入商业贿赂的怪圈而不能自拔。商业贿赂的泛滥必将损害我国社会主义市场经济体制的正常运行。我国反商业贿赂法律体系存在条文散乱、范围狭窄、主管机关不统一、会计规则不严格等问题，完善我国反商业贿赂的法律体系是根治商业贿赂的制度保障。本文从我国市场竞争中商业贿赂的危害和产生原因入手，指出当前我国治理商业贿赂工作的缺陷，通过国外市场竞争中商业贿赂法律规制的解析及对我国的启示，提出了对我国商业贿赂进行法律规制的具体措施。

Abstract:In recent years, our country market of commercial bribery phenomenon are serious, it became part of the further development of market “rule”. Some companies have become a hotbed of commercial bribery, into the circle and commercial bribery. Commercial bribery in the flood will damage our socialism market economy system runs normally. Our legal system against commercial bribery, narrow terms, the competent authority, accounting rules are not strictly, perfecting the legal system against commercial bribery is the system guarantee of the commercial bribery. Based on our market competition of commercial bribery and causes damage, it is pointed out that current bribery in business, through the defect in the foreign market competition law regulation of commercial bribery in China and the enlightenment to China, and puts forward the legal regulation of commercial bribery concrete measures.
