摘要：随着新技术不断涌现，专利法律制度面临着种种的挑战。信息技术在生物技术之先就带给了时代以重击，划时代的发明创造把人类带进了信息时代。之后又不断涌现各个领域的新兴科技。生物技术、电子商务运营方法、低碳技术等诸多领域的一系列里程碑式的成果，使人们的生产、生活方式由此发生了翻天覆地的变化。然而传统意义上的专利法律制度的保护在这些时代的新宠儿面前显得些许苍老无力。
新技术时代下，高新技术的迅猛发展给我国专利法律制度带来挑战的同时也带来了机遇。就我国而言，为了顺应时代发展，满足人们的需求，克服现有专利权标准的不足，更好的实现专利制度的价值目标，本文试图以生物技术、电子商务运营方法和低碳技术为例，分析新技术的特性；通过对欧美国家的专利法律制度的分析研究，比较并借鉴一些经验以应用于我国特殊的国情基础上的专利法律制度，提出个人建议，试图探讨我国专利法律制度应顺应时势而作出调整或改善的意见。在具体分析过程中主要就专利法律制度中客体范围和专利的实质性条件这两个方面来论述，体现新技术对专利法律制度的挑战。最后，由以上的经验总结，对我国专利法律制度的改善提出个人建议，简单的说明制度改善的思路和大体方向。

Abstract:With the new technology constantly emerging, patent law system faces many challenges. Information technology in biological technology will bring the era before to critical hits, landmark inventions human into the information age. After emerging and all areas of the emerging technology. Biological technology, e-commerce operation method, low carbon technology and many other fields of a series of landmark achievement, make people's production and life style which has undergone earth-shaking changes. However the traditional sense of the patent law system of protection in these times before the new favorite of appear some old and weak.
New technology age, the rapid development of high and new technology in our country in patent law system of challenges at the same time, it brings the opportunity. In our country's character, in order to comply with the development of times, meet the demands of the people, to overcome the deficiency of the current patent standard, better realize the value target of the patent system, this paper attempts to biological technology, e-commerce operation methods and low carbon technology as an example, this paper analyzes the characteristics of new technology; Through to the European and American countries patent law system analysis, comparison and learn some experience for use in a specific conditions in China on the basis of the patent law system and puts forward personal Suggestions, tries to discuss the patent law system in our country should conform to the time and make adjustments or improve opinion. In the concrete analysis the main process of patent law system is in range of substantive and patent object conditions this two aspects discusses, reflect new technology to patent law system of challenges. Finally, the above the experience of our country, the improvement of the patent law system puts forward personal Suggestions, simple explanation system improve the ideas and general direction.
