摘要:在现代商品经济的竞争中，驰名商标蕴含了无限的商机和巨大的经济利益，在企业的竞争中发挥着不可或缺的作用，进而导致对驰名商标淡化的行为也越来越严重。因此，驰名商标反淡化保护已经成为人们关注的焦点。本文笔者从驰名商标反淡化的理论出发，结合经典案例，阐述了在对驰名商标进行反淡化保护时应注意的问题，以及在理论研究中应注意的问题。

Abstract:In the competition of the modern commodity economy, well-known trademarks have huge commercial opportunities and values, and they play very important roles in the competition of companies. Due to this reason, well-known trademarks dilution becomes more serious, so the anti-dilution of well-known trademarks becomes the focus. In this paper, the author from the theory of well-known trademarks dilution, combining with the classical case, elaborate the problem which well-known trademark anti-dilution protection should pay attention to and the theory of study should pay attention to.

随着我国市场经济的不断发展，消费市场竞争空前的激烈。我国同其他国家一样。面临着驰名商标被淡化的问题。相对于一些欧美国家而言，中国对驰名商标防止淡化的保护还有很大差距。笔者认为，目前我国防止驰名商标淡化的问题已经迫在眉睫，加大对驰名商标的保护，不仅是一种国际上的趋势，更多的是实际经济社会生活中一种需要。通过对驰名商标的反淡化保护，可以维护驰名商标所有人的合法权利，保障消费者的正当利益，更有助于一个良好的正当的社会经济竞争秩序的形成。
关于驰名商标反淡化问题的研究在我国目前仍处于起步阶段，应当多加注重向国外取经，并且结合我国的实际情况。笔者相信，随着理论的深入发展，我国关于驰名商标的反淡化保护会提升到一个更高的水平。
