摘要:离婚损害赔偿制度，是我国婚姻法立法上的一大进步。但它在立法和司法实践中仍然存在很多问题。离婚损害赔偿制度进一步的立法完善已经成为我国法律理论研究的必需。本文结合法学界学者关于离婚损害赔偿制度的研究，对离婚损害赔偿进行分析，并针对我国离婚损害赔偿制度的立法缺失提出一些自己的看法和建议。
本文分为四个部分来讨论离婚损害赔偿制度的相关法律问题。第一部分阐述了离婚损害赔偿的概念、特征、构成要件及其法定情形和功能。第二部分对瑞士、法国以及我国台湾的有关的离婚损害赔偿制度立法例进行了比较分析，从而指导我国的立法实践。第三部分对我国目前离婚损害赔偿制度实践中的不足与缺陷进行补充和完善。最后就离婚损害赔偿制度提出自己对对我国婚姻法的立法的构想。

Abstract:Compensation regulation for divorce damages, which is remarkable process for our marriage law legislation, but it’s still lack of perfect about legislation and judicial practice, so it’s necessary to optimize the compensation regulation for divorce damages in legal theory research field. This thesis makes reference for some scholar research about compensation regulation for divorce damages, to make deep analysis about this compensation regulation, and put forward to some new ideas and suggestion regard to the lack of perfect legislation about compensation regulation for divorce damages.
This thesis is divided into four parts to discuss compensation regulation for divorce damages and the relevant legal problems. The first part described the concept, characteristics, constitutive requirements and their legal case and function about the compensation regulation. The second part compared with other countries and area about the compensation regulation, such as Switzerland, France and China Taiwan area, so as to guide the practice for legislation. The third part made some complement and optimization about the deficiency and lack of perfect for compensation regulation in practice. Finally, as to compensation regulation for divorce damages, put forward to the specific measure suggestion about the marriage law legislation in practice.
