摘要：惩罚性赔偿责任是英美法系国家广泛采用的一种特殊的赔偿责任制度，具有惩罚、预防等功能，在许多国家的立法中有相应的规定，并在多年的司法工作中得到了发展。作为民事领域一项特殊的权利救济方式，惩罚性赔偿责任是弥补传统损害赔偿制度中补偿性赔偿之不足的最好方式。目前我国虽已确立了惩罚性赔偿责任，但仍存在诸多的不足。本文首先阐述完善惩罚性赔偿责任的必要性，接下来指出惩罚性赔偿责任的缺陷，通过借鉴国外惩罚性赔偿责任先进经验，最后提出惩罚性赔偿责任的完善措施，以期达到营造良好的社会信用体系的目的。

Abstract：The punitive damages of common law countries is widely adopted as a special liability system, has features such as punishment, prevention, in the legislation of many countries in the corresponding provisions, and in the years of judicial work obtained the development. As a special field of civil rights relief, the punitive damages responsibility is to make up for the traditional system of compensation for damage in compensatory damages the deficiencies of the best way. Although our country has established the punitive compensation responsibility, but there are still many shortcomings. This paper expounds the necessity of perfecting the punitive damages responsibility, then points out the defects of punitive damages, punitive damages through drawing lessons from foreign advanced experience, finally puts forward the measures to perfect the punitive damages responsibility, in order to compensate victims, punish the offender, preventing illegal behavior occurs, and jointly create a good social credit system.
