摘要:社会上每个人都平等地享有生存权、生命健康权、人格权、性自主权和经济权利等，都有自己的人格尊严，应当得到法律的普遍关怀，保护弱势群体是法正义价值和人道主义精神的体现。我国对家庭暴力的立法虽然对家庭暴力救济起到了一定的作用，但只注重事后社会救济措施，没主张先预防措施，还是有一定的局限性。笔者通过借鉴国外构建反家庭暴力法律制度的经验，对构建我国反家庭暴力法律制度提出了具体的若干建议。

Abstract:Social each person in the equally enjoy life, life and health, personality right, sexual autonomy and economic rights and so on, all have their own human dignity, and should get legal common concern, protect vulnerable groups is the law justice value and the humanitarian spirit embodiment. The legislation of our country to family violence though of domestic violence relief has some effect, but only pay attention to social relief measures afterwards, didn't claim to preventive measures, there are still some limitations. The author of the family violence against foreign legal system construction experience, for the establishment of the legal system of domestic violence in our country puts forward concrete Suggestions on it.

家庭是社会的细胞，和睦、安宁、温馨的家庭不仅是每个家庭成员人生幸福的重要内容，也是社会稳定的基础。然而当前，无论是在发达国家还是在发展中国家，家庭暴力都不同程度地存在着。家庭暴力的存在严重地侵扰这家庭的安宁，破坏着社会的稳定和发展，并且是妇女、儿童、老人和残疾人成为首当其冲得受害者。因此，预防和制止家庭暴力，维护和保障人权，特别是妇女等弱势群体的合法权益，构建我国反家庭暴力的法律制度对于遏制家庭暴力，维护人权有着极其重要的意义。
