摘要:韩非子的“法治”思想对我国的传统法制建设有深远的影响,而其功过是非一直备受争议。本文通过对韩非子“法治”思想的实质内涵的重点探讨,进一步指出其思想中的进步性和合理性,并对其不合理之处进行逐一剖析。尽管韩非子“法治”思想中的“法治”并非现代意义上的法治,但其对法治建设刚起步的我国具有一定的借鉴意义。笔者试图从韩非子“法治”思想与近现代法治思想的比较中,提炼其思想的可取之处,对现今社会的法治建设作出启示。

Abstract:The “nomocracy ideology”, a thought of Han fei zi, has had effort on traditional legal construction and been argued for it’s merits. Based on the essence of “nomocracy ideology”, this paper points out it’s rationality and irrationality. The legal construction of China should use the “nomocracy ideology” as a source of reference, altuough the “nomocracy ideology” of Han fei zi is different from modern thought. In order to put forward some advices on legal construction, the author tries to compare the “nomocracy ideology” of Han fei zi with the modern thought, so that the essence of Han’s ideology can be used.

韩非的法治学说,虽然是维护封建专制制度的,但作为宝贵的文化遗产,对法治建设刚起步的我国具有一定的借鉴意义。在社会主义现代化法制建设过程中,分析和借鉴其法治思想中合理的成分,把法的主体由君主和官府转变为人民,把君权至上、专制法治观念导致的法的工具性转变为人民依法自治理念下的法的契约性与民主性,充分保障社会民主和公民自由,坚持与时俱进的法治精神,把“以法治国”与“以德治国”相互结合起来,从公民个人道德自律和社会公众契约的外在强制两方面入手,为建设有中国特色的社会主义法律体系而努力。
